What we see instead is the insistence that liberal policy preferences simply must be constitutional. "I'm confident that this will be upheld because it should be upheld," said Obama.In a way I would almost like to see the Court decline to overturn Obamacare. That would focus the conservative majority of this country on November as nothing else ever could. It would practically guarantee the Dems lose control of the Senate as go deeper into the hole in the House. It would guarantee Obamacare's repeal as closely as it can be guaranteed. And it would orient voters like nothing else that administrations come and they go, but their judicial appointees stay on for decades.
